Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Hailcat LLC (“Hailcat,” “we,” “us,” or “our”) governing your use of the Hail Cat game (the “App”) and the website at hailcat.app (the “Site”). By downloading, installing, or using the App or Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App or Site.

1. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority where you live, you must have your parent or guardian’s permission to use the App.

2. License

Subject to these Terms, Hailcat grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, and to use the Site, for your own personal, non-commercial entertainment. We reserve all rights not expressly granted.

3. Things you agree not to do

You agree not to:

• copy, modify, reverse engineer, decompile, or create derivative works of the App, except as permitted by law;
• use cheats, bots, exploits, or unauthorized software to gain an unfair advantage or to disrupt the App or other players;
• harass, abuse, or harm others, or choose a username or content that is unlawful, offensive, infringing, or that impersonates someone else;
• interfere with or attempt to gain unauthorized access to the App, the Site, our servers, or other players’ devices or accounts;
• use the App or Site for any unlawful purpose or in violation of these Terms.

4. Your content

The App lets you choose a nickname and capture screenshots, and future online features may let you choose a username. You are responsible for what you submit and must have the right to use it. You keep ownership of your content, and you grant Hailcat a worldwide, royalty-free license to use it as needed to operate the App and its features (for example, displaying your username on a leaderboard). We may remove content or restrict access for content that violates these Terms.

5. The game, updates, and online features

We may update, change, or discontinue the App, the Site, or any feature (including online features and leaderboards) at any time. Online features require a network connection and may be unavailable from time to time. We do not guarantee that the App or any feature will always be available or error-free.

6. Purchases

The App currently has no in-app purchases. If we add purchases or subscriptions in the future, they will be handled by Apple under the App Store terms, and any additional terms will be presented to you at the time of purchase.

7. Intellectual property

The App, the Site, and all related content — including the Hail Cat name, the cat characters, artwork, music, and code — are owned by Hailcat LLC or its licensors and are protected by intellectual-property laws. Except for the limited license above, nothing in these Terms transfers any rights to you.

8. Apple App Store

Because you download the App from Apple’s App Store, the following also apply:

• These Terms are between you and Hailcat LLC only, not Apple, and Hailcat (not Apple) is solely responsible for the App and its content.
• Your license to use the App is limited to use on Apple-branded products that you own or control, as set out in Apple’s App Store Terms of Service and the Licensed Application End User License Agreement.
• Apple has no obligation to provide any maintenance or support for the App.
• To the maximum extent permitted by law, Apple has no warranty obligation for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims are Hailcat’s responsibility.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product-liability claims, claims that the App fails to meet a legal or regulatory requirement, consumer-protection claims, or intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist-supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Disclaimers

The App and Site are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, Hailcat LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the App or Site. Our total liability for any claim relating to the App or Site will not exceed the greater of the amount you paid us for the App in the 12 months before the claim or US $25. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Hailcat LLC from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the App or Site or your violation of these Terms.

12. Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your access to the App or to online features if you violate these Terms. Provisions that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New Jersey will have exclusive jurisdiction over any dispute that is not subject to small-claims court, and you consent to their jurisdiction. Nothing here limits any non-waivable consumer rights you have under the laws of your home jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date above. Your continued use after changes take effect means you accept the updated Terms.
